Bare Smiles (64 878 795 346) ("Bare Smiles", "we", "us", "our") is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, hold, use and disclose personal information (including health information) through:

  • our website, www.baresmiles.com.au;

  • our smile-assessment and enquiry tool, baresmiles.app;

  • our online booking system, Acuity Scheduling;

  • our clinical practice management software, Core Practice;

  • our marketing activity on Meta Ads (Facebook/Instagram) and Google Ads; and

  • CCTV and other on-site surveillance at our practice premises.

By using our website, baresmiles.app, or attending our practice, you agree to the collection, use and disclosure of your personal information as described in this Policy.

2. What personal information we collect

Depending on how you interact with us, we may collect:

  • Identity and contact information — name, email address, phone number, date of birth and postal address, e.g. when you make an enquiry, book an appointment, or become a patient.

  • Health information (sensitive information) — including photos of your teeth/smile submitted via baresmiles.app, the treatment(s) you are interested in or have received, clinical notes, dental charting, x-rays, and treatment plans and history, held in Core Practice.

  • Booking and appointment information — collected via Acuity Scheduling, including appointment times, service selected, and reminders/notifications you receive.

  • Website and app usage information — IP address, device/browser type, pages viewed, referral source, and interactions, collected via cookies and similar tracking technologies.

  • Marketing and advertising data — collected through Meta Pixel/Conversions API and Google Ads/Analytics tags, such as ad interactions, campaign engagement, and (where applicable) hashed contact details used for ad matching.

  • CCTV footage — images of individuals who attend our practice premises, captured for security purposes.

  • Payment information — payment method type and transaction details (we do not store full card numbers; payments are processed via EFTPOS/HICAPS).
     

3. How we collect personal information

We collect personal information:

  • directly from you, when you complete a form on our website, submit a photo or enquiry via baresmiles.app, book an appointment via Acuity Scheduling, or provide information in person or by phone/email at our practice;

  • automatically, through cookies and tracking pixels when you browse our website or interact with our ads on Meta or Google;

  • via CCTV cameras operating at our practice premises; and

  • from third parties, such as a referring practitioner, with your consent, where relevant to your care.

4. Sensitive and health information

Smile photos, treatment interests, and clinical records are "sensitive information" under the Privacy Act and are subject to a higher standard of protection. We only collect this information with your express consent, and only use it to: provide you with a smile assessment or dental services; prepare a treatment plan or quote; and maintain your clinical record.

We do not use identifiable patient photos, stories, or testimonials in our marketing unless we have your specific, separate written consent, given the restrictions on testimonials in advertising a regulated health service under the Health Practitioner Regulation National Law.
 

5. How we use your personal information

We use personal information to:

  • assess enquiries and provide the smile-assessment feature on baresmiles.app;

  • schedule, manage, and remind you of appointments via Acuity Scheduling;

  • provide dental treatment and maintain accurate clinical records via Core Practice;

  • process payments and manage your account;

  • send you appointment reminders and service-related communications;

  • with your consent, send you marketing communications (see clause 7);

  • measure and improve the performance of our Meta and Google advertising;

  • maintain the safety and security of our practice premises, staff and patients (CCTV); and

  • comply with our legal, regulatory and professional obligations (e.g. AHPRA and Dental Board of Australia record-keeping requirements).
     

6. On-site surveillance (CCTV)

We operate CCTV/surveillance cameras at our practice premises for the safety and security of our patients, staff and property. Cameras are located in reception, waiting areas and common areas only, and are not used in consultation or treatment rooms. Signage is displayed on our premises to notify you that surveillance is in operation, consistent with our obligations under the Surveillance Devices Act 1999 (Vic). Footage is stored securely, access is restricted to authorised personnel, and footage is retained only as long as reasonably necessary (typically no more than 30 days, unless required for an investigation or legal process) before being securely deleted.
 

7. Direct marketing

We will only send you direct marketing communications (e.g. by email or SMS) with your consent, in accordance with the Spam Act 2003 (Cth). Every marketing message will include a simple way to unsubscribe. If you ask us not to contact you for marketing purposes, we will add your details to our internal do-not-contact list. We do not make marketing phone calls to numbers on the Do Not Call Register unless we have your consent or an exemption under the Do Not Call Register Act 2006 applies.
 

8. Advertising: Meta Ads and Google Ads

We use Meta Ads (Facebook and Instagram) and Google Ads to advertise our services and measure the performance of our campaigns. This may involve:

  • placing cookies or similar technologies (e.g. Meta Pixel, Google Ads tag, Google Analytics) on your device when you visit our website;

  • sharing limited information (which may include hashed/de-identified contact details or online identifiers) with Meta Platforms, Inc. and Google LLC to measure ad conversions and, where enabled, to build custom or lookalike audiences; and

  • showing you retargeted ads based on your prior visits to our website.

Meta and Google are based in the United States and process this information under their own privacy policies, meaning your information may be disclosed and held overseas (see clause 11). You can control this by:

  • adjusting your ad preferences at facebook.com/adpreferences and adssettings.google.com;

  • opting out of interest-based advertising via youronlinechoices.com.au or the Network Advertising Initiative; and

  • adjusting cookie settings in your browser.
     

9. baresmiles.app

baresmiles.app allows prospective and existing patients to submit a photo of their smile and receive an indicative smile assessment, and to leave their contact details and treatment interest with us. Information submitted via baresmiles.app (including photos, contact details, and treatment preferences) is treated as sensitive/health information under clause 4 and is used only to respond to your enquiry, provide you with an assessment, and, with your consent, follow up with relevant information about our services. This information may be added to your clinical record in Core Practice if you become a patient.
 

10. Acuity Scheduling (online bookings)

We use Acuity Scheduling, provided by Squarespace, Inc. (United States), to manage online appointment bookings. When you book an appointment through our website or baresmiles.app, your name, contact details, and appointment information are collected and processed by Acuity Scheduling on our behalf, which involves your information being disclosed and stored overseas (see clause 11). Acuity Scheduling's own privacy practices are available at acuityscheduling.com/privacy.php.
 

11. Overseas disclosure

Some of our service providers (including Meta, Google, and Acuity Scheduling/Squarespace) are based overseas, primarily in the United States, and personal information may be stored on servers located outside Australia. Where we disclose personal information overseas, we take reasonable steps to ensure these providers handle your information consistently with the Australian Privacy Principles, including by relying on their published privacy and security commitments. By using our website, baresmiles.app, or booking through Acuity Scheduling, you consent to this overseas handling of your information.
 

12. Data storage and security

We store health and clinical information in Core Practice, our clinical practice management software, which employs industry-standard security measures including access controls and encryption. We take reasonable technical and organisational steps to protect all personal information we hold from misuse, interference, loss, unauthorised access, modification or disclosure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
 

13. How long we keep your information

We retain clinical records in accordance with our professional obligations, generally for a minimum of 7 years from the last date of treatment for adult patients, and until a patient turns 25 for records created while they were a minor, consistent with Dental Board of Australia guidance and applicable state health records law. CCTV footage and website/marketing analytics data are retained only for as long as reasonably necessary for the purposes described in this Policy.
 

14. Access and correction

You may request access to, or correction of, the personal information we hold about you by contacting us using the details in clause 18. We will respond within a reasonable time and may need to verify your identity before releasing information. There may be circumstances where we are permitted by law to refuse a request for access or correction, in which case we will explain our reasons.
 

15. Complaints

If you have a concern about how we have handled your personal information, please contact us in writing using the details below. We will investigate and respond within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
 

16. Children's privacy

Where a booking or enquiry is made on behalf of a child or minor, we rely on the consent of a parent or guardian to collect and use that child's personal and health information.
 

17. Changes to this Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements.
